Waiver and Release of Liability
Please Read Carefully Before Participating:
By joining and participating in Run Club Domestique's organized group runs, you are agreeing to the following terms and conditions. I understand that the run club's activities include physical exercise, and that the consumption of alcohol is an optional activity that occurs after the run.
1. Acknowledgment and Assumption of Risks. I know that running with a group and volunteering for this club are potentially hazardous activities that could cause injury or death. I am aware that participation in this club involves risks including, but not limited to:
- Physical injury, including falls, sprains, and temperature-related issues.
- Traffic and road hazards.
- Impairment of judgment and physical abilities.
I will not participate in any group run unless I am medically able and properly trained. I certify that I am medically able to perform all activities associated with the club, am in good health, and am properly trained for a group run. I will not consume any alcohol before arriving at the designated run location. I understand that my participation is conditional on me being sober at the start of the run and that the organizers reserve the right to deny my participation if I appear to be under the influence of alcohol.
2. Waiver and Release of Liability. Having read this waiver and knowing these facts, I, for myself and anyone entitled to act on my behalf, hereby waive and release Run Club Domestique, its organizers, leaders, representatives, and volunteers, as well as Domestique Wine, its owners, employees, and affiliates (collectively, the "Releasees") from any and all claims, liabilities, or demands of any kind arising out of my participation with the club. This release includes, but is not limited to, claims for injury, death, or property damage, even if such claims arise out of the negligence of the Releasees.
3. Gross Negligence and Intentional Acts. This waiver does not apply to claims arising from gross negligence, willful misconduct, or intentional acts by the Releasees.
4. Alcohol Consumption Clause. Should I choose to consume any alcohol provided by Domestique Wine, I affirm that I am of legal drinking age in the District of Columbia. I understand and agree that it is an optional component of the event, and I am solely responsible for my own decision to consume alcohol. I agree not to hold the Releasees liable for any injury, damage, or legal issues resulting from my consumption of alcohol, including any incidents that occur after I have left the premises.
5. Indemnification. I agree to indemnify, defend, and hold harmless the Releasees from any and all losses, liabilities, damages, costs, or expenses (including reasonable attorney's fees) arising from my participation in the club, including any claims brought by a third party because of my actions.
6. Photography and Recordings. I grant permission to use my photographs, motion pictures, recordings, or any other record for any legitimate promotional purposes for the club.
7. Representations and Consent. I acknowledge that I have read and agree to abide by the Run Club Domestique Code of Conduct. I understand that I am responsible for my own safety and acknowledge that I have read and fully understand the contents of this waiver. I agree to comply with all rules and regulations of Domestique Wine regarding the service and consumption of alcohol.
